1. Overview of Services
Best Local is a California-based provider of search engine optimization (SEO) services designed to boost your online visibility. We offer subscription plans that help local businesses improve their search rankings. These services are delivered on a 30-day recurring subscription basis, with automatic renewals unless canceled according to our cancellation policy.
The scope of the services you receive will be outlined in your chosen plan, which may include keyword tracking, optimization of local business listings, SEO reports, and other tailored services designed to enhance your online presence.
2. Subscription Terms
Automatic Renewal:
All subscriptions will renew automatically every 30 days. Your payment method on file will be charged at the start of each new billing cycle.
Billing Authorization:
By subscribing to our services, you give us permission to charge your payment method for each renewal period. A payment receipt will be sent to your email upon each transaction.
Cancellation Process:
You may cancel your subscription at any time by providing us with written notice via email to contact@bestlocal.us. Notice must be given at least 30 days prior to your renewal date. If you do not provide timely notice, your subscription will automatically renew for the next period.
Activation of Guarantee Plans:
For plans with a ranking guarantee, billing will begin only after Best Local successfully ranks at least one (1) of your selected keywords in the top 3 positions of Google’s local search results. Rankings will be verified using our proprietary Keyword Heatmap tool. A keyword is considered ranked in the top 3 if it appears in the top 3 positions for at least one grid point on the heatmap.
3. Refund Policy
Non-Refundable Payments:
All payments made for our services, including both initial and renewal payments, are final and non-refundable.
No Partial Refunds:
If you cancel your subscription before the end of a billing cycle, you will not be entitled to a partial refund. Your service will continue until the end of the current 30-day period.
4. Client Responsibilities
Providing Accurate Information:
To ensure optimal results from our services, you must provide accurate and complete information when requested by Best Local. Any delays or issues that arise due to incomplete or inaccurate information are your responsibility.
Legal Compliance:
By engaging with our services, you agree to comply with all relevant laws, rules, and regulations. We reserve the right to suspend or terminate services if we believe they are being used for unlawful or unethical purposes.
5. Intellectual Property & Work Product
Upon full payment for services rendered, you are granted a non-exclusive, non-transferable license to use the SEO materials provided (such as reports, keyword data, and other deliverables) for your internal business purposes. Best Local retains ownership of all intellectual property rights to the work product until full payment is received.
6. Communication & Privacy
By subscribing, you consent to receive communications from us regarding service updates, billing notifications, and marketing offers via email, text, or other electronic channels. You may opt out of marketing communications at any time by following the unsubscribe link provided in each message or contacting us directly.
Privacy Commitment:
We are committed to protecting your privacy. Any personal data you share with us will be handled in accordance with our Privacy Policy, which complies with applicable privacy laws.
7. Limitation of Liability
We use proven SEO strategies, but Best Local cannot guarantee specific rankings or sustained performance due to external factors like search engine algorithm changes, competitive activity, or other variables beyond our control.
To the maximum extent allowed by law, Best Local will not be held liable for any direct, indirect, incidental, or consequential damages resulting from changes in search rankings, website performance, or related SEO outcomes.
8. Force Majeure
We are not liable for failure to fulfill our obligations if caused by circumstances beyond our control, including but not limited to acts of nature, technical difficulties, internet outages, cyberattacks, labor disputes, or changes in search engine algorithms ("Force Majeure Events").
9. Dispute Resolution
If a dispute arises under these Terms, both parties agree to first attempt to resolve it informally through discussion. If we cannot reach a resolution within 30 days, the dispute will be settled by binding arbitration in San Jose, California, in accordance with the rules of the American Arbitration Association. Any arbitral award may be enforced in any court with jurisdiction.
10. Governing Law
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of laws principles. Any legal action arising from these Terms will take place exclusively in the courts located in San Jose, California.
11. Amendments to These Terms
We may update or modify these Terms at any time. If any material changes are made, we will notify you via email at least 14 days before the changes take effect. Continued use of our services after the update will indicate your acceptance of the revised Terms.
12. Severability
If any provision of these Terms is deemed invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect.
